Welcome to Clarity Health ("we," "our," or "us"). By creating an account, accessing, or using the Clarity Health application (the "Service"), you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
1. CRITICAL MEDICAL DISCLAIMER
CLARITY HEALTH IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.
1.1 Informational Use Only:
The content generated by Clarity Health, including transcripts, summaries, action items, and AI chat responses, is for informational and organizational purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment.
1.2 AI Limitations:
Our Service utilizes Artificial Intelligence (AI) to transcribe and summarize audio. AI systems are fallible. They may misinterpret speech, hallucinate (invent) facts, or provide incorrect dosage information. You agree to:
Never rely solely on the App for critical health decisions.
Always verify instructions, medications, and diagnoses against official records provided by your healthcare provider.
Consult with a qualified healthcare provider regarding any medical condition.
2. RECORDING LAWS & USER RESPONSIBILITY
YOU ARE SOLELY RESPONSIBLE FOR COMPLYING WITH RECORDING LAWS.
2.1 Consent to Record:
Laws regarding the recording of private conversations vary significantly by jurisdiction.
In the United States: Some states require the consent of all parties (Two-Party Consent), while others require only one.
International Users: In the European Union (GDPR), Canada (PIPEDA), the UK, and other regions, strict consent and privacy laws apply to recording individuals.
2.2 Your Obligation:
By using the "Record" feature, you represent and warrant that you have obtained all necessary consents from all participants in the conversation (including doctors, nurses, and staff) as required by your local, state, provincial, or national laws.
3. PRIVACY POLICY
We take your privacy seriously. This section outlines how we handle your data.
3.1 Data Minimization:
Clarity Health prioritizes data privacy.
Audio Data: We process audio recordings locally within your device's browser memory (RAM) or via secure encrypted streams to third-party transcription providers. We do not store raw audio files on our servers. The audio exists temporarily on your device to facilitate the transcription process and is discarded once processing is complete or the session ends.
Transcripts: Text transcripts are encrypted at rest and in transit.
3.2 Data Ownership:
You retain full ownership of your health data. You may export or delete your account and all associated data at any time via the App settings.
3.3 Third-Party Processing:
We utilize trusted third-party vendors (e.g., Deepgram for transcription, Google Gemini for summarization) to provide the Service. We configure these services to prohibit the use of your identifiable health data for training their general AI models.
3.4 No Sale of Data:
We do not sell, rent, or trade your personal health information to advertisers or third parties.
3.5 GOOGLE USER DATA POLICY
To ensure transparency and compliance with Google's API Services User Data Policy, we explicitly disclose the following regarding your Google User Data:
Data Accessed: When you choose to "Sign in with Google," Clarity Health accesses the following personal information from your Google Profile: Email Address: Used as your unique account identifier and for service-related communication. Full Name: Used to personalize your profile and interface.
Data Usage: We use this Google User Data solely for the purpose of: Authenticating your identity and securing your account. Creating and managing your user profile within the Clarity Health application. Sending critical service notifications (e.g., password resets, subscription updates).
Data Storage & Sharing: This data is stored securely in our encrypted database provided by Supabase. We do not sell, rent, or trade your Google User Data. We do not share your Google User Data with third parties for advertising purposes. We do not use this data to train generalized AI models.
4. ACCEPTABLE USE
You agree NOT to use the Service to:
Record conversations surreptitiously or illegally.
Record conversations where you are not a participant.
Upload data that is fraudulent, harmful, or violates the rights of others.
Attempt to reverse engineer the AI models or scrape data from the Service.
Circumvent usage restrictions, including but not limited to creating multiple accounts to exploit free trials or manipulating the App to bypass recording limits.
5. SUBSCRIPTIONS AND BILLING
5.1 Free Trial:
We may offer a limited free trial (e.g., 2 free appointments). We reserve the right to modify trial terms at any time.
5.2 Subscriptions:
Paid subscriptions (Clarity Health Pro Monthly and Clarity Health Pro Yearly) are billed in advance.
5.3 Cancellations:
You may cancel your subscription at any time via the App settings or your Stripe customer portal. Access to paid features will continue until the end of the current billing cycle.
6. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, CLARITY INNOVATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; OR (D) DATA LOSS RESULTING FROM DEVICE FAILURE, BROWSER ERRORS, OR CONNECTIVITY ISSUES, AS AUDIO DATA IS STORED TEMPORARILY IN YOUR DEVICE'S MEMORY.
7. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Clarity Innovation, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with:
Your access to or use of the Service, including any reliance on the transcripts, summaries, or AI-generated advice provided by the App;
Your violation of these Terms;
Your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right;
Your violation of any applicable laws, rules, or regulations, including but not limited to recording consent laws and health privacy regulations.
